Practitioner Terms of Service & Privacy Policy

Effective Date: January 2026

This agreement ("Agreement") is between you ("Practitioner," "you," or "your") and Zen Zebra Consulting LLC, operating as Precision Protocols ("Precision Protocols," "we," "us," or "our"), a Connecticut limited liability company.

By purchasing access to Precision Protocols and using our services, you agree to be bound by these terms. If you do not agree, do not use the service.

1. Service Description

Precision Protocols is a software tool that generates personalized supplement protocols using Designs for Health (DFH) products based on client assessment responses. The tool connects to your DFH virtual dispensary, allowing clients to purchase recommended products with your practitioner retailer code applied.

The service is a decision-support tool. It is not a substitute for your professional clinical judgment.

2. Eligibility

By using Precision Protocols, you represent that you are:

  • A health and wellness practitioner operating within your legal scope of practice
  • Authorized to recommend dietary supplements in your jurisdiction
  • An active Designs for Health practitioner with a valid virtual dispensary

3. Practitioner Responsibilities

You agree that:

  • You are solely responsible for all supplement recommendations made to your clients, whether generated by this tool or modified by you
  • You will review protocols as appropriate for your practice and client needs, particularly if you enable the approval gate feature
  • You will not rely solely on this tool for clients with complex medical conditions, known allergies, contraindications, or medication interactions
  • You are responsible for operating within your scope of practice and complying with all applicable laws and regulations in your jurisdiction
  • You will maintain appropriate professional liability insurance for your practice
  • You are responsible for your own HIPAA compliance (if applicable) and for managing client relationships through your own systems

4. Client Relationships

Precision Protocols does not create a relationship between us and your clients. You are the sole provider of services to your clients. We are a tool provider to you.

When clients complete assessments through your Precision Protocols link:

  • You are responsible for how you introduce and frame the tool to your clients
  • You are responsible for any follow-up, support, or guidance related to protocols
  • You are responsible for handling any adverse reactions, complaints, or questions from your clients

5. No Medical Advice

Precision Protocols does not provide medical advice, diagnosis, or treatment. The protocols generated by this tool are informational and educational in nature.

We are not licensed healthcare providers. The tool's output is based on algorithmic matching of assessment responses to supplement products and should not be construed as clinical recommendations from Precision Protocols or Zen Zebra Consulting LLC.

6. Designs for Health Products

Precision Protocols is optimized for use with Designs for Health products. We are not affiliated with, endorsed by, or partnered with Designs for Health unless explicitly stated otherwise.

Product descriptions, ingredients, and availability are subject to change by DFH. We make reasonable efforts to keep product information current but do not guarantee accuracy.

You acknowledge that:

  • Supplement purchases occur through DFH, not through Precision Protocols
  • Commissions, shipping, returns, and product issues are handled by DFH according to their policies
  • We have no control over DFH's eScript system, product availability, or fulfillment

7. Fees and Payment

Founding Practitioner Access:

  • Basic Access: $197 one-time fee
  • Basic + Custom Assessment: $597 one-time fee

Founding practitioner fees include 6 months of access and discounted subscription rates thereafter, as described at the time of purchase.

Future Subscription (after founding period):

  • Standard rate: $30/month
  • Founding practitioner rate: $20/month

Refund Policy:

All fees are non-refundable. Because access to the service is delivered immediately upon purchase, we do not offer refunds. If you experience technical issues that prevent you from using the service, contact us at hello@precisionprotocols.io and we will work to resolve them.

8. Account and Access

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your access if you:

  • Violate these terms
  • Use the service in a manner that could harm other users or our reputation
  • Misrepresent your credentials or scope of practice
  • Fail to pay applicable fees

9. Intellectual Property

All content, design, algorithms, and software associated with Precision Protocols are owned by Zen Zebra Consulting LLC. You may not copy, modify, distribute, or reverse engineer any part of the service.

You retain ownership of your practice branding (logo, colors) that you upload to the platform. By uploading, you grant us a limited license to display your branding within the tool for the purpose of white-labeling your client experience.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The service will be uninterrupted or error-free
  • Protocols generated will be appropriate for any particular client
  • Product information will be accurate or current
  • The service will meet your specific requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEN ZEBRA CONSULTING LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS OR REVENUE
  • LOSS OF CLIENTS
  • DAMAGE TO PROFESSIONAL REPUTATION
  • CLIENT ADVERSE REACTIONS OR HEALTH OUTCOMES
  • ANY DAMAGES ARISING FROM CLIENT USE OF RECOMMENDED SUPPLEMENTS

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Zen Zebra Consulting LLC, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

  • Your use of the service
  • Your clients' use of protocols generated through the service
  • Your breach of these terms
  • Your violation of any applicable law or regulation
  • Any claim that your use of the service caused harm to a third party

13. Privacy Policy

Information We Collect From Practitioners

When you create an account, we collect:

  • Name
  • Email address
  • Phone number
  • Practice name
  • DFH dispensary URL / retailer code
  • Logo and brand colors (if provided)

Payment information is collected and processed by ThriveCart. We do not store your credit card or payment details.

Information Collected Through Client Assessments

When clients complete assessments through your link, we collect:

  • Assessment responses (not linked to any client identity)
  • Session codes (for approval gate feature, if enabled)
  • Generated protocols and driver scores (for analytics and service improvement)

We do not collect client names, email addresses, or any personally identifiable information from clients. The session code system is designed so that only you maintain the connection between a code and a specific client in your own records.

How We Use Information

We use practitioner information to:

  • Provide and personalize the service
  • Communicate with you about your account
  • Send service-related notifications
  • Process payments (via ThriveCart)
  • Improve the service

We use anonymized assessment data to:

  • Generate protocols
  • Analyze aggregate trends
  • Improve our algorithms and product recommendations

Third-Party Services

We use the following third-party services to operate Precision Protocols:

Data Retention

We retain practitioner account information for as long as your account is active or as needed to provide services. If you cancel your account, we will delete your information within 90 days, except as required for legal or accounting purposes.

Anonymized assessment data may be retained indefinitely for analytics and service improvement.

Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

Your Rights

You may:

  • Access the personal information we hold about you
  • Request correction of inaccurate information
  • Request deletion of your account and associated data

14. Modifications to Service and Terms

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will make reasonable efforts to notify you of significant changes.

We may update these terms from time to time. If we make material changes, we will notify you by email or through the service. Your continued use after changes take effect constitutes acceptance of the revised terms.

15. Governing Law and Disputes

This Agreement shall be governed by the laws of the State of Connecticut, without regard to conflict of law principles.

Any dispute arising from this Agreement shall be resolved through binding arbitration in Connecticut, except that either party may seek injunctive relief in court for intellectual property violations or other urgent matters.

16. General Provisions

  • Entire Agreement: This Agreement constitutes the entire agreement between you and Precision Protocols regarding the service.
  • Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
  • Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
  • Assignment: You may not assign this Agreement without our written consent. We may assign it in connection with a merger, acquisition, or sale of assets.
